We are a four unit condo building with three units owner-occupied. The other unit owner lives out of state and rents her unit. The current tenants have a lease through July 2012. Due to ongoing issues with this owner and her rental situation spanning over 6+ years with multiple leases/tenants, including bylaw violations with respect to rentals, the Board of Directors would like to change the association bylaws to “no rentals.” We plan to have a meeting to vote on the proposed change before summer. We anticipated having a ¾ majority vote in favor of the change, however there is some disagreement about how to handle the current lease situation; whether or not to grandfather in the current tenants for one additional year beginning with end of current lease. There is indication they would like to extend their lease. These tenants have been highly problematic (filing false discrimination claim against the association, bylaw violations with respect to property storage, and excessive noise/domestic disturbances). The unit owner/landlady has been hands-0ff.

Our question: Once this bylaw change is voted in, what should the board do with respect to the tenants and unit owner to protect the association from possible legal fallout?

A Rather Suite Comstock Apple Is Picked

As we wrote about 1333 Jones #705 this past September:

The master suite within #705 at the Comstock (1333 Jones) sports a big San Francisco view, a designer bath (or at least shower), and a rather master worthy closet.
Unfortunately the guest bath didn’t get the same designer makeover as the rest of the unit. But if you were our guest, we'd say help yourself to a few of the 300 bottles in the built-in cooler and spend your time soaking up... the views.
Purchased for $2,400,000 in September 2007, the Comstock two-bedroom is back on the market listed for $2,349,000 four years later. As plugged-in people know, the unit two floors below sold for $2,000,000 in 2010 but wasn’t nearly as well "designed."

The sale of 1333 Jones #705 closed escrow yesterday with a reported contract price of $2,269,000, down 5.5 percent ($131,000) on an apples-to-apples basis versus 2007.
